Save The Alien Legal Fund

The legal battle that is going to ensue between myself, the Yellow Alien, and the Black Ninja, aka Angelo Sotira, is going to be costly. Lawsuits are never cheap. While Angelo has the ability to make use of any, and all, deviantART revenue generated from subscription purchases, print purchases, and more, in order to protect “the corporation” I do not have an “unlimited” budget at my disposal.

Scott:

I’m not a deviant. But one day while I was briefly checking my friend’s dA page, I noticed a few little yellow aliens dotting the avatars in people’s comments. Since then I’ve been reading about what happened. As an outsider I weighed all the evidence and one thing became clear; ’spyed’ is wrong. YOU should be running the show. So I’ve donated what I can to your cause. Know this; you aren’t just in the hearts of the dA faithful; your story has touched someone who rarely even went to the site. This isn’t just a matter of who should be in charge of dA; this is a matter of right and wrong.

-A voice.

p.s. I hate ninjas. Always have. They only do wrong and have no honor.

The best I can do is hold off my subscription for a while, until this blows over. I have a fundraiser of my own to set sail, but I wish you luck, deviantART is just ART without Jark.

If this doesn’t get worked out in the end I’m going to drive across country, knock on Angelo’s door and bother him with incessant and mildly immature whining until he gives in.

You know the majority of your website backs you. *smiles*

Best of wishes,

This is still going down then. I wasn’t sure how things were standing, after your previous “I’M OUT” kind of journal.

I see it’s adding up already. I’ll have to consult the other half about this, but either way, I’m linking you up and hope you get enough.

Done!! I love watching it grow. Good luck with this fund!

6 the1bigboy/fra Sep 5th, 2005, at 23:59:55

this mean that DA could be offline for a while?

7 Daniel Sep 6th, 2005, at 02:06:15

I doubt this lawsuit is going to drain dA of all funds. ^_^

Good luck to you Scott, that’s currently all I can give you. I’m on student funds so I can’t spare any money. :(

8 Zebulin Sep 6th, 2005, at 05:56:03

And here I was about to re-up my registration at deviantart. I won’t do that and give him the money to fight against you with. I’ll just wait until this is done.

Glad to hear the legal matters are getting underway. I guess one of the most important things is get your dA stock ownership back to 45%… I mean, that figure changing is just so blatantly conspicuous.

Time for some serious probing.

10 Mom-BookDiva Sep 7th, 2005, at 07:14:26

Glad to see the retainer fee went out.

11 lemontea Sep 7th, 2005, at 11:49:43

Although I doubt this is a comment that will appear on your site if you have any control over it (bad propaganda), I want to be honest with you.

Asking for donations for your legal fees when thousands of people are publicly dead or dying as noble as terrorizing children on the street.

If I have ever supported you in the past, I will never support you in the future. I just wanted you to know this.

12 Scott Sep 7th, 2005, at 14:18:18

Thousands of people die every day. There is never a “good time” to ask for donations. It is a tough decision to come to.

Ultimately, as you can see, people wanted to donate so I merely offered a way to make that happen easily.

You are free to disagree and voice that. I thank you for your eloquent thoughts. :-)

You have never supported me before so it does not come as a surprise to see you making that sentiment known publicly. Even on this website, which I happen to have *complete* control over, thank you very much.

13 teriyaki Sep 7th, 2005, at 20:25:59

Is your lawsuit against dA inc or Angelo himself? Because if it’s against Angelo then surely he can’t legally use the sites funds, other than his pay & any dividends he’s been paid - that’s part of the trade off of incorporating.

14 Simon Dann Sep 8th, 2005, at 04:20:12

I dont see what lemonteas’ problem is, you need help, people want to help you and you provided a easy way of doing so. Also what teriyaki said is a good point, are you fighting a lawsuit against deviantart or Angelo, because teriyaki is right, if it is a lawsuit against Angelo then he cant legally use the sites funds. Anyway I shall donate a little money to you as soon as I can afford it :) Good luck, im behind you.

15 Amz Sep 8th, 2005, at 06:21:34

I’ve already said on your DA that I intend to support you, and I’ll say it again here…as soon as I have the ways and means to do so, I’ll be adding to the balance here. After all, working more than full time means you earn more than you can spend. =P

As for the comments about timing…you’re right, there is never a good time to ask for donations, though this is about the right time to do so. Some will donate here, some will donate to the victims of Katrina, and some will donate to both. It’s their perogative. Those who whine about someone else’s choice should simply compensate with their own funds instead of making a fuss.

I hope this will all be a success, and I am only too happy to contribute to it. That’ll be soon, too.

16 Levi Sep 8th, 2005, at 21:05:19

Good luck mate, seems you’ve got a hell of a lot of support already! I hope all goes well for the both of you and neither has to walk away from this in too much pain (financially, emotionally and physically).

I however wont be contributing. I have two reasons for this, the first being that I don’t support either you or Angelo exclusively, I support deviantART. I love you Scott, but theres no way I’m taking sides between two guys I look up to and love equally.

The second is that I don’t have any money to give anyway.

Good luck mate!

I’ve never been much of a vocal person, however, I just think that what has been done to you is blatantly unfair. How in the world did Spyed even manage to oust you? You would think that you should be able to stop a CEO from doing something like getting rid of the beloved co-founder!
Also, as they said above, are you fighting a single person or dA itself?

18 Levi Sep 17th, 2005, at 12:33:14

Also, as they said above, are you fighting a single person or dA itself?

There is no way in hell Scott is fighting DA, just Angelo. If he were fighting DA I would have already had him assassinated. ;)

19 macoute Sep 25th, 2005, at 10:12:13

Why not sell your current holding to Fox? Then when Rupert’s bending the managment over during the induction process you can start up a new DA with the $ from the sale - BTW I am serious.

Another possibly more palatable solution is to sell “rights” to the story via eBay - or even contact Wired etc? Contact Harvard business school to lecture on “being shafted” (changing the title of course).

If you do not have an “unlimited” budget, then drop the lawsuit, and stop begging others for money.

21 Dillon C Jun 13th, 2006, at 13:17:35

I happened across the story of Jark while randomly browsing devart; to be quite honest, I had never given time nor thought to the founders of deviant art or its corporate structure. At the current juncture I am seriously considering leaving devART as a member based on my disgust for the current administration, despite the fondness I hold for the community; I will certainly be more seriously considering the creation of a personal site to showcase my work. Angelo’s actions in this case are not only blatantly immoral, but also appear to be illegal; leaving the potentially more serious actions alone, the simple witholding of financial documents from a qualified shareholder was a legal infraction that will merit some punishment should this case ever see completion (as I sincerly hope it does).

I’m with you Jark- I gave what I could at the current time, and apologize for its slight stature; the budget of one paying for college is continually strained. I’ll continue giving when I have some spare dollars, and should I experience some windfall you will certainly know about it.

Good luck, and keep us updated.

I am a deviant and i have to say that i agree with you.
This court case shows that it is the last straw.
Spyed is wrong and you should not have been fired.
You clearly love deviantart for the hope of spreading love in the ever growing art community and you main concern was for the welfare of the artists. Nothing else.
I support you and i hope that Spyed pays for behaving like this, even though i am not 100% sure what this argument is about, i think that it has got out of control andhould be stopped.
You were wrongly fired and so i wish you the best of luck in the court case.
Good luck, true deviantart founder!

Whatever happened to the charges you were going to file? Or have you? I think you should update everyone.

24 shelly Dec 17th, 2007, at 11:36:22

An update would be a good thing; I agree. *nods*

25 joseph Dec 19th, 2007, at 07:16:00

An update? You thought he was actually going to sue?

26 Thomas Dec 31st, 2007, at 13:29:49

Jark, why don’t you start a new art site? Or team up with an art site so that you are back in the game? Deviantart seems to be more focused on numbers these days. They must be making millions off of ad space alone. Quality control is out the window and people are starting to view the site as nothing more than a printing company. I know that it was not your intention for the site to end up like that. Seriously, why not create a new site or team up with another site, like http://www.artwanted.com or http://www.myartspace.com ? I bet at least half of deviantarts membership would follow you once word spread that you are making another site or joining forces with another site.
